NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, ASIA BUSINESS ADVISOR'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO ASIA BUSINESS ADVISOR FOR THE SERVICE DURING THE TERM OF MEMBERSHIP, BUT IN NO CASE WILL ASIA BUSINESS ADVISOR'S LIABILITY TO YOU EXCEED $500. YOU ACKNOWLEDGE THAT IF NO FEES ARE PAID TO ASIA BUSINESS ADVISOR FOR THE SERVICE, YOU SHALL BE LIMITED TO INJUNCTIVE RELIEF ONLY, UNLESS OTHERWISE PERMITTED BY LAW, AND SHALL NOT BE ENTITLED TO DAMAGES OF ANY KIND FROM ASIA BUSINESS ADVISOR, REGARDLESS OF THE CAUSE OF ACTION.
CERTAIN LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
Indemnification:
By accepting this user agreement, you agree to indemnify and otherwise hold harmless Asia Business Advisor, its officers, employees, agents, subsidiaries, affiliates and other partners from any direct, indirect, incidental, special, consequential or exemplary damages resulting from i) your use of the Asia Business Advisor Service; ii) unauthorized access to or alteration of your communications with or through the Asia Business Advisor Service, or iii) any other matter relating to the Asia Business Advisor Service.
Without limitation of the terms and conditions set forth in our Privacy Policy, you understand and agree that Asia Business Advisor may disclose personally identifiable information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to comply with legal process, enforce this user agreement, or protect the rights, property, or safety of Asia Business Advisor, its users, and the public. |
